Austin (WBAP/KLIF News) – A federal judge is granting a request for an injunction against the US Department of Labor’s regulation increasing the number of workers nationwide who qualify for overtime pay. The injunction means the rules will not go into effect on December 1st, and will likely be struck down by President-Elect Donald Trump, once he takes office in January.
“This summer, 21 states, Texas and Nevada leading the way, filed a lawsuit, asking that there be a preliminary injunction that these overtime rules be stopped,” said Texas Attorney General Ken Paxton. “Which would have resulted in a loss of jobs.”
Paxton says at the heart of their argument is that an executive branch department — like Labor — can’t just change the rules. He says it’s Congress’ job to make law, not the administration’s.
He expects Trump to make rescinding a number of President Barrack Obama’s executive actions a priority.
