DALLAS (WBAP/KLIF) – The family of a Dallas man who died after being handcuffed by Dallas Police will have its day in court.
Tony Timpa died in 2016 after being pinned to the ground by Officers for 14 minutes. Criminal charges against the Officers were dropped, and a Dallas judge said the Officers weren’t liable in civil court. But the Fifth Circuit Court of Appeals saw it differently, and overturned the ruling.
“Because the fifth circuit is such a conservative circuit, there are going to be a lot of other circuits that are going to be saying, oh wow we are all in agreement here, said family attorney Geoff Henley . “This is something that will affect law enforcement nationwide.”
When Timpa’s mother Vicki heard the decision, she thought she was dreaming.
“I thought I was asleep,” said Vicki Timpa. “I was awake. I slapped my face and cried.”
The family is now moving forward with a lawsuit.
